Energy planners have estimated that growth in the Brazilian economy will require more than 27,000 MW of new electrical capacity by 2003. While most of Brazil`s infrastructure has been built and financed by the national government, much of the new electric infrastructure will be developed, financed and owned by the private sector. The legal framework for private sector participation in the electric sector is beginning to take shape. On July 10, 1995, the Brazilian legislature enacted the Public Services Law which establishes a framework for private participation in the electrical sector. At the heart of this framework is the independent power producer (IPP) which is described as an entity that obtains a concession or authorization from the applicable granting authority for the purpose of producing electric energy for sale in commerce. According to the Brazilian government, the difference between an IPP and a concessionaire is that an IPP competes freely for his account and at his risk while a concessionaire is subject to the regulations of public service. The PUblic SErvice Law represents a critical first step toward facilitating private participation in the Brazilian energy sector. Investors should welcome this new development with a view toward assessing its significance for the many opportunities that lie ahead.
