Will EPAct kill gas IRP?

State commissions don`t want to implement federal regulations that tell natural gas utilities how to conduct integrated resource planning and how to charge and spend for conservation and demand management. At least, that`s what they seem to be saying. Unwillingness to implement, however, may not be the same thing as unwillingness to follow. Commission responses to section 115 of the Energy Policy Act of 1992 (EPAct) from 21 states and the District of Columbia include 18 outright rejections and no outright acceptances. Twelve of those decisions claim that resource planning already is sufficiently regulated by the state. The 22 states that didn`t respond already mandate some form of integrated resource planning (IRP) or demand-side management (DSM) or have dockets open to consider doing so.
