Legal developments emphasize need for safety training in drilling and well servicing
Current legal developments of which safety directors should be aware by focusing on the Occupational Safety and Health Act of 1970 (OSHA), recent developments in the field of worker's compensation in Texas and Oklahoma, and a proposed federal statute concerning the criminal act of endangerment are examined. The OSHA's Hearing Conservation Amendment (HCA) which requires employers to monitor noise level when an employee's exposure level equals or exceeds an 8-hr. time weighed average of 85 db is criticized. Since rig employees are often highly mobile, short term personal monitoring (8 hrs. or less) is not likely to provide an adequate representation of future exposure. Violation of the OSHA which shows extreme indifference to life is punishable by up to 40 months imprisonment and a fine of up to $250,000 ($1,000,000 if the defendant is a corporation).
