Title: New U.S., Canadian and Mexican hazmat regulations

An overview is presented of the regulatory development process in each country, and each of the changes taking place now and in the next couple of years are covered. Regulations throughout North America are based upon activities at the UN. In the US the regulatory development process begins with the agency perceiving the need for a new or altered regulation. Next the agency begins to gather information on the subject. This may be done informally through telephone conversations, letters or informal meetings. Information may also be solicited on a more formal basis, by publishing a series of questions on the subject in the Federal Register; the responses will assist the DOT in formulation of a proposal to add to or change the regulations. Once the DOT has gathered information and digested it, a Notice of Proposed Rulemaking is published, with an opportunity to comment on the now-framed regulation. Once DOT accumulates and considers the additional comments received, a Final Rulemaking is published, including an announced date on which to begin complying with the new rule. The system of regulatory development in Canada, is roughly parallel to that in the US. There, the Proposed Rule is called ``First Gazetting``; the Canadian equivalent to their Federal Register is called the Canada Gazette. Their Final Rule is called ``Second Gazetting``, and mandatory compliance dates are included, as they are here. Instead of Docket numbers, Canada`s dockets are called ``Schedule`` numbers. The public is permitted to comment on a First Gazetting, and comments are considered by Transport Canada in formulating a finalized regulation.
