Environmental law and the siting of facilities: issues in land use and coastal zone management

This book provides an analysis of various aspects of environmental law, as this dynamic field applies to land use, coastal zone management, and the siting of facilities. The perspective and the materials provided reflect a relatively unique approach to the subject of environmental law, an approach designed to provide useful information to the several fields of practice and education that are now increasingly involved in environmental management and in the planning, design, siting, and development of constructed facilities. This book thus will appeal to a broad range of professionals and students in fields of law, planning, design, engineering, and public policy. The materials are grouped in two major parts that focus on developments in environmental law that (1) are relevant to land use planning and decision making on the siting of facilities, and (2) are central to facility siting in the coastal zone. In each part, description and analysis of major laws and regulatory programs are provided, and numerous references are made to judicial and agency decisions on actual facility siting cases. This balance between the generic and the specific provides for a stimulating and pragmatic treatment of this complex field, as well as fully reflecting the limitations of current laws and programs and the forces at work in society that make the field dynamic and open-ended. Traditional land use controls such as zoning, and traditional features of common law such as nuisance, have been extensively dealt with in numerous other works, and have been determined to be of limited utility to the growing societal problem of making decisions on new facilities through the balancing of environmental and economic interests. These traditional subjects are not dealt with in this book, but the reader is advised of their continuing, though limited, significance.
