PCBs haunt utilities

Many small utilities have found that they are still liable for the risks of contamination from polychlorinated biphenyls (PCBs) even after they have hired an independent waste management company to remove the materials from the utility site. The disposal companies often serve a number of utilities, create a potentially hazardous waste site, then go out of business. Superfund law places responsibility upon generators and users, even those whose activity preceded the Toxic Substance Control Act. The author recommends approaches that will help utilities limit their liability. These include selecting a contractor who disposes of contaminated materials rather than storing them.
