Natural oil vs. converted oil: a lawyer's views

Tar sands, oil shale, gilsonite, and coal can be processed to yield converted oils. Historically, state oil and gas regulatory agencies have concerned themselves only with conventional oil-well drilling and oil-production practices, and have not become involved in the business of regulating oil produced by a conversion process. Certain methods advocated by industry for converting and extracting synthetic oil from hydrocarbon deposits in situ come very close to practices already regulated under existing authority such as the following: (1) fire-flood method of heating and converting tar sands to yield liquid petroleum products; (2) fire-in-the-hole method for producing converted oil from oil shales; (3) in place burning of coal beds to yield coal gas and related hydrocarbons; (4) underground nuclear explosions; (5) non-explosive underground nuclear heating devices; (6) introduction of diluents and hot water into buried tar sands deposits; and (7) in place hydrogenation of high volatile coal deposits. Regulatory practices administered by existing agencies could be easily extended to cover synthetic oils when commercial production becomes a reality.
