Evaluation of dyes submitted under the toxic substances control act new chemicals program

Section 5 of the Toxic Substances Control Act (TSCA) requires companies to report all new chemical substances to the EPA (Environmental Protection Agency) before they can be imported, manufactured, processed or distributed in the US. These Pre-Manufacture Notices (PMNs) contain information on the manufacture, use, potential release to the environment, toxicity and possible human exposure to the new substance. The EPA reviews these notices and has the power to impose a range of restrictions if the new substance is believed to pose a significant hazard to human health or the environment. In the ten years that TSCA has been in effect, the EPA has received over 10,000 Premanufacture Notices for new chemical substances. A significant number of these notices (up to 10% of the submissions each year) are for dyes. The large number of dyes, and the high potential for toxicity of dyes and/or dye fragments have made this class of compounds one of the most extensively reviewed under the new chemicals program. This presentation will cover four topics as they apply to premanufacture notices for dyes: (1) the procedure that EPA has established to review notices will be outlined; (2) information included in the notices will be summarized; (3) specific concerns for human health and/or the environment that were expressed by the Agency during review of the PMN dyes will be discussed, the final evaluation and disposition of PMN dye cases will also be summarized; (4) data on existing dyes (those that had an established market before TSCA came into effect) will be presented.
