Enforcement of the resource conservation and recovery act (RCRA)

A discussion showed that the development of the hazardous waste enforcement program of the RCRA is guided by four underlying objectives. The first is to respond to emergency or imminent hazard situations that pose an immediate threat to human health or the environment. The second objective is to establish a competent community of treaters, storers, and disposers and to encourage voluntary compliance with regulations. Thirdly, it is important to prevent hazardous wastes from being directed to nonpermitted facilities. The fourth objective is to reduce the probability and effects of leaks, accidents, or spills during the handling or transport of hazardous wastes. Conventional enforcement situations would be handled through the following steps: notice of violation, administrative compliance order, civil action, civil penalty, and suspension or revocation of permit. Enforcement priorities are, in decreasing order of importance: generators of hazardous waste which treat, store, or dispose on site; generators of hazardous waste which transport their wastes offsite, treatment, storage, and disposal facilities; and transporters of hazardous waste.
