EPA poised to issue test rules on certain HAPs

Representatives in the .. Environmental Protection Agency (EPA) Office of Pollution Prevention and Toxics have been briefing interested parties in the past few months on several forthcoming test rules EPA plans to issue under Section 4 of the Toxic Substances Control Act (TSCA). The test rules would seek toxicity data for dozens of hazardous air pollutants (HAPs) regulated under Section 112 of the Clean Air Act. TSCA applies to people and companies that manufacture, process, distribute, use or dispose of TSCA-regulated chemicals. One of EPA's key information-gathering provisions is TSCA Section 4, which authorizes it to require chemical manufacturers and processors to generate data on the health and environmental effects of certain chemicals. Under TSCA, EPA may require manufacturers and processors to generate these data when a chemical is believed to pose an unreasonable risk'' of injury, or substantial quantities of the chemical are produced with the potential for substantial environmental or human exposure. More recently, EPA has been using its TSCA Section 4 authority to obtain information on multiple chemicals believed by EPA to pose health risks to a common endpoint.
