The concentration of valuable energy resources on Indian reservations will inevitably lead to more struggle between various Indian and non-Indian interests for possession and control of those resources and the wealth that their exploitation can generate. The courts have already decided that Indian tribes have the authority to tax oil and gas operations on their land, but the oil companies may now seek to prevail by calling on the plenary power of Congress. The plenary powers concept has found routine use as the premise and often the solution to numerous questions that arise in the analysis of legal problems involving American Indians, such as land transfers. The author searches the Constitution and court decisions to see how the concept of guardianship is interpreted in dealing with Indian affairs. 185 references.
