Corporate standing under NEPA: will economic injuries suffice

Provisions of the National Environmental Policy Act (NEPA) are analyzed to determine when and under which circumstances they can be used to prevent corporate gain or challenged to protect corporate interests. Challenges because of alleged economic injuries have not met with consistent judicial responses. Several decisions are reviewed to illustrate that, while the courts have not presented clear and consistent reasoning, they have tended to require that plaintiffs suffer valid environmental injuries before they are granted standing as economically injured. Clarification of NEPA through a definitive Supreme Court ruling is suggested.
