A great deal of controversy has been generated during the past few years over the boundary between the juridictions of federal and state governments over energy transactions, particularly those involving the sale and transmission of electricity. The U.S. Supreme Court has addressed this subject, but has done little to resolve the difficult questions that arise when both federal and state authorities claim jurisdiction over energy transactions. This jurisdictional debate is discussed in this paper. The debate implicates very serious issues of social and economic policy. It is shown that state commissions are accumulating pervasive influence in the area of transmission access, even though the legal basis for exercise of this jurisdiction is doubtful. 75 refs.
