The Clean Air Act`s revitalized attainment program

One of the most prominent features of the 1990 ammendments to the Clean Air Act is the attainment program. The program is predicated upon a simple regulatory approach: the federal government sets numerical standards representing minimally acceptable air quality and all areas of the country are required to attain and maintain those standards. Failure to attain the standards results in the imposition of sactions. However, attainment is a problem for many urban areas, particularly with respect to ozone, carbon monoxide and particulates. This article provides an overview of the attainment program. The following topics are covered: designation and classification of nonattainment areas; elements of nonattainment plans; sactions; subordination of transportation to air quality priorities.
