Managing the public lands: the authority of the executive to withdraw lands

A review and analysis of judicial interpretations of executive withdrawal authority in the past leads to suggestions for developing a statutorily-based withdrawal authority. Court challenges to executive withdrawal authority are less likely to succeed in the present milieu of resource conservation. Defining the reach of authority, as well as the authority under withdrawal statutes, is a task for the executive himself. Pervasive congressional concern with conservation makes administrative actions that tend to protect publicly-owned resources virtually invulnerable to judicial challenge. 309 references.
