Settlement practice at the FERC: boom or bane

An examination of the use of settlement procedures as a tool to resolve issues and proceedings at the Federal Energy Regulatory Commission focuses on recent decisions. The author concludes, on the basis of these cases, that FERC's dispositions are currently ambiguous on the lengths to which it is willing to go to encourage settlements of claims. The author cites the United Municipal Distribution Group v. FERC decision, which seeks to avoid litigation, and the Northern Natural Gas Co. decision, which seems to contradict willingness to encourage settlements.
