The California Public Utilities Commission has approved a settlement modifying its Final Standard Offer 4 contract for power purchases by electric utilities from qualifying cogeneration and small power production facilities (QFs). The order implements Commission policies on various matters, including project fees and milestones, environmental externalities, emission monitoring, economic curtailment, project viability and security, levelized payments, liquidated damages, foreign firm eligibility, and bid evaluation. It offered guidelines to help buyers and sellers negotiate standard offer contracts, explaining that bargaining flexibility formed an important attribute of a fully competitive generation market.
