Report charges feds pulled punches on criminal probe

A congressional subcommittee of the House Committee of Science, Space, and Technology claims that the Justice Department was not aggressive enough in prosecuting Rockwell International for environmental crimes at the Department of Energy's Rocky Flats nuclear weapons plant. It also faults DOE for failure to control its contractors and safety and effectively manage its facilities. The subcommittee charges that by agreeing to a settlement that shielded Rockwell and its workers from other federal and state prosecution, the government allowed Rockwell to avoid millions of dollars in additional fines. After a five year investigation, Rockwell pleaded guilty to five felonies and five misdemeanors under the Resource Conservation and Recovery and Clean Water Acts and paid a 18.5 million dollar fine. The Justice Department claims that the report is misleading, incomplete, and full of inaccuricies and asserts it made sound prosecutorial judgements based upon the evidence.
