The Federal Energy Regulatory Commission (FERC) issued a Notice of Inquiry on April 24, 1991 seeking comments on how to best implement the Administrative Dispute Resolution Act (ADRA) and whether changes in the FERC's regulations are necessary or appropriate to facilitate the use of alternate dispute resolution techniques. This paper discusses ADR procedures in use at the FERC, the Regulatory Fairness Act, the Negotiated Rulemaking Act, the status of FERC ex parte rulemaking proceedings, service, official notices, and paper hearings.
