The videotape is divided into two sections. Section 1 provides an overview of Consent Decrees (CDs) and the statutory authority provided under CERCLA Section 122. It details settlement tools and identifies potential problems and possible solutions in settlement negotiations. The role of the Department of Justice (DOJ) and other Federal agencies in this process is discussed. Section 2 discusses an Administrative Record (AR), its purpose and contents, how it is completed, and the roles and responsibilities of Agency and non-Agency staff. In addition, potential challenges encountered in developing the AR file and the importance of preparing an AR file are discussed.
