Environmental permitting: expediting the NEPA process

The Council on Environmental Quality (CEQ) developed regulations for administering National Environmental Policy Act (NEPA) permits that provide four opportunities to expedite the process: (1) avoid multiple environmental reviews, (2) provide early environmental information to permit agencies, (3) request that environmental impact statement time limits be set, and (4) design projects to avoid adverse impacts. The author discusses two unresolved issues of whether permit agencies with minor roles in large private projects should conduct project-wide NEPA analyses and whether permit agency NEPA documents should evaluate alternatives beyond the applicant's ability to implement. Case histories involve projects of the Corps of Engineers.
