Antitrust compliance for electric utilities

The courts increasingly are treating electric utilities like ordinary unregulated firms for antitrust purposes. In addition, the regulatory agencies have superimposed (or been required to superimpose) additional antitrust burdens on utilities. These developments make it imperative that the utilities adopt antitrust compliance programs as protection against antitrust liability. This article provides pointers toward the essential elements of such programs. It concludes that while such compliance programs will not guarantee an investor-owned utility will avoid antitrust scrutiny, it can minimize potential liability.
