Policy and legal conflicts in the Pacific Northwest Power Act

Pending legislation in the US Congress indicates interest and impetus for the authorization of regional conservation and electric power planning agencies in more than one section of the country. Such provisions were enacted for the Pacific Northwest in 1980. An analysis of the enabling legislation shows some important differences from the new proposals, including some inconsistencies and reversals which suggest a possible need to reopen the entire public power-private power debate. The legal inconsistencies in the Power Act could provide ammunition to those wishing to challenge its legal legitimacy. 4 references.
