Outcome of cogeneration cases to affect buy-back terms

Three key issues currently being decided by state utility commissions and the Federal Energy Regulatory Commission that will impact on the future cogeneration regulations are discussed. These are: (1) the method of determining the amount of capacity that each cogenerator will contribute to a utility and to the holding company that owns it and whether and to what degree state or federal commissions should regulate this calculation; (2) the perceived threat that a utility commission might overturn a buy-back contract after it takes effect; and (3) federal or state authority to order and regulated rates for wheeling power to a service area beyond the cogenerator's own utility.
