Standards of adequacy for an EIS for off-shore leasing

A chronology is given of the events leading to a proposed sale of leases for expediting drilling in the Baltimore Canyon and the subsequent court challenges and appeals based on whether the environmental impact statements (EIS) satisfied the requirements of the National Environmental Policy Act (NEPA). The courts found the EIS did not adequately address the impact of pipeline placement, the threat of oil spills from tankers, and other matters of jurisdiction. At issue were whether more meaningful information could be gathered and at what stage of the project was the additional information needed. The Court of Appeals set a review standard for EIS, but distinguished between projects that would be difficult to modify once construction begins and those which could be multistaged.
