This Special Institute deals with a variety of techniques for resolving and/or avoiding disputes, primarily in the area of natural resources. Because of increasing costs of litigation, including the cost of corporate time loss and project delay, avoidance of protracted litigation has become a primary concern of corporate management. An understanding of, and appreciation for, the alternative methods of dispute resolution is vital both to corporate personnel and to every law firm and practitioner who may have the occasion to work within these parameters for corporate clients. Included are discussions of: shortcomings of litigation in dispute resolution and a survey of alternatives to judicial determinations, litigation risk/cost analysis techniques, methods to effectively manage complex multi-party disputes, alternatives within the judicial system, regulatory negotiation, policy dialogue and negotiation, alternative dispute resolution techniques, how to achieve the advertised benefits of arbitration, how and when to mediate natural resource disputes, diagnosing contract clauses which are litigation traps, mining agreement provisions for preventing or minimizing litigation, and ethical considerations in dispute avoidance and resolution.
