New PSD regulations: EPA seeks to resolve the continuing controversy

Efforts to implement the Clean Air Act Amendments requiring states to develop mechanisms to ensure the prevention of significant deterioration (PSD) are complicated by several factors: (1) present data-gathering techniques are inadequate for effective decision making; (2) the Environmental Protection Agency's attempt to expand its authority was successfully challenged; and (3) the balance of law and policy was challenged by both industry and environmentalists. A review of the PSD program and its legal challenges illustrates the controversy that surrounds the program. Positive results are the active participation by industry and environmental groups to resolve siting decisions. The search continues for further areas of compromise and adjustment. 152 references.
