Investment credit and joint ventures

The Internal Revenue Service (IRS) has determined that the tax portion of joint ventures involving public or municipal and investor-owned utilities does not preclude the utility from benefiting from investment tax credits for partial ownership, although the tax investment credit is not available to the portion owned by a municipality or cooperative. The author defines the terms and explains the qualifications and applications of the tax laws, which he illustrates for specific cases. He also identifies several loopholes in the structural component of the law. The complexities of the law, however, may well prevent many utilities from taking advantage of the IRS interpretation.
