New regulations from the US EPA, originally due in November 1992 but now expected in summer 1993, will revise and update the present federal air quality regulations to comply with directives of the Clean Air Act (CAA). Explorations of the required retrofits at waste-to-energy (WTE) plants postponed until now will begin to take place. In the proposed Emission Guidelines EPA is making some significant changes and additions. The proposal includes the first specified limits for mercury emissions, and issuance of the first rules for small facilities. The proposal also includes regulations for controlling dust from ash handling and transport facilities. The new rules will expand rules to cover more WTE facilities; for the first time, federal rules will be issued for small facilities, applying to all municipal waste combustors (MWC) of 39 TPD or greater. Under the new definition, any plant having a total capacity greater than 250 TPD will be classified and regulated as large. Facilities with total capacities from 39 to 250 TPD will be regulated as small. Facilities with capacities less than 39 TPD will not be subject to the new federal air quality regulations, though they may be covered by similar state or local regulations.
