Surface v. mineral owners claim near-surface uranium deposit

The ownership of a shallow uranium deposit in Duval County, Texas, was in dispute between the surface owner and a half-interest mineral owner in Crews v. Platinum Trading Co., 827 S.W.2d 455 (Tex.App.-San Antonio 1992). Crews, the surface estate owner and also owner of one-half of the mineral estate, filed for declaratory judgement to determine ownership of the near-surface uranium deposit underlying their 1,900-plus acres. The surface owner based his claim of sole and total ownership of the shallow uranium deposit on the fact that the commercially mineable uranium deposit was located between 150 and 190 ft. below surface, and only exploitable by surface mining methods which would totally consume, deplete, or destroy the surface of the land. The legal aspects of this dispute are summarized.
