Houston Lighting and Power seeks cut-rate cogeneration capacity - cogenerators seek cease and desist order

Houston Lighting and Power invited cogenerators and prospective cogenerators to bid on the purchase of 600 MW of firm capacity, the price to be determined by the lowest bid rather than by avoided costs. The request is in response to a need for additional capacity, but there is a motion to restrain the utility on the grounds that it violates the Public Utility Regulatory Policies Act, which bases capacity payments on the utility's avoided costs. The article cites several instances in which the Houston utility is in conflict with PURPA and may be abusing its power as a monopsonist.
