Criminal sanctions, personal civil penalties, and special investigations under the Federal Mine Safety and Health Act of 1977: a practitioner's approach

The Coal Mine Health and Safety Act of 1969 did not begin investigating alleged violations until 1973, and it was 1977 before the provisions relating to criminal and civil penalties were applied to non-coal mining. The author describes the investigative procedures for a variety of problems and solutions. One problem is that the practitioner under investigation must choose between avoiding further proceedings or emerging with the as good a record as possible for defense in later proceedings. Preparation is the key to effective representation under investigation.
