EPA policy on delayed compliance orders: a need for clarification

Clarification of the Clean Air Act Amendment enforcement policies issued by the Environmental Protection Agency (EPA) focuses on the limiting effects the policies have on state variances. The EPA must approve implementation of delayed compliance to avoid a noncompliance penalty, although the state must first grant a variance for attainment of the state implementation plan (SIP) beyond the date set for attaining national ambient air quality standards. An explanation of the EPA's position on nonattainment and attainment covers Sections 113 (d) and 172 (a).
