FERC rules that power generated downstream of heat extraction qualifies for PURPA treatment

A Federal Energy Regulatory Commission (FERC) ruling that electric power generated from steam which passes through the condenser without being extracted for heating purposes qualifies for electric power generation under the Public Utility Regulatory Policies Act (PURPA) is discussed. The decision in the Texas Industries, Inc. case simultaneously resolved qualification issues for seven other cogenerators. At issue was the definition of a cogeneration facility and the decision to add the ''sequential use'' requirement to the statutory definition. The decision opens the door for relatively inefficient cogeneration, and opens the FERC rules to criticism.
