State acid rain programs: Progress & issues in Phase II SO{sub 2}, NO{sub x}, & opt-ins permitting

Almost all States have adopted acid rain permitting regulations as part of their title V operating permits programs, and will be adopting acid rain NO{sub x} regulations in the near future. Phase II affected sources achieved a high degree of compliance with the statutory requirement to submit initial Phase II acid rain permit applications by January 1, 1996. The Acid Rain Opt-in Program is being implemented, sources are submitting opt-in permit applications to EPA and permits have been issued. Phase II NO{sub x} regulations are being promulgated, affected sources are submitting NO{sub x} early election plans to EPA, and Phase II NO{sub x} guidance for States will be distributed in 1997. Forty CFR part 72 (the acid rain program permits regulation) is being revised primarily to streamline the permitting process for State and local permitting authorities and to improve integration with 40 CFR part 70 (the state operating permits program regulation). Acid rain permitting demands will increase for States over the next 3 years, current State adherence to statutory and regulatory acid rain permitting requirements for Phase II affected sources remains high.
