Asbestos and the insurer as lender, employer, and property owner

Insurance companies have experienced asbestos-related legal problems as insurers of asbestos manufacturers or as insurers of property owners or businesses where friable asbestos is present. This paper documents other asbestos-related legal problems insurance companies are likely to encounter. The insurance company as the foreclosing lender; the insurance company as an employer; and the insurance company as property owner. As the legal and health-related risks of exposure to friable asbestos are extraordinarily high, as the future course of litigation in this area is unpredictable, and as insurance companies with their reputation of deep pockets traditionally have been special targets of liability plaintiffs, extreme care should be taken by insurance companies when dealing with asbestos-related issues. Yet these issues should not be ignored. Frequent and intense consultation with experienced and competent environmental engineers or architects and with legal counsel is advised most strongly.
