The Price-Anderson Improvement Act of 1985 (S. 1761) amends the Atomic Energy Act, establishes the availability of liability insurance from private sources as the amount of protection required, and sets liability levels for nuclear incidents. The purpose of the bill is to ensure full compensation to the public in the event of an accident involving a licensee of the Nuclear Regulatory Commission or involving the transport and disposal of nuclear wastes. The bill describes administrative procedures and the responsibilities of the Energy Secretary to include indemnification agreements in contracts. The amendments change procedures in dealing with a nuclear incident and in handling a public liability action. The courts must limit payment for any one incident to no more than 33 1/3% of the financial protection or 15% of the limit of liability.
