Utility regulation and the Clean Air Act Amendments of 1990

The focus of this paper is on acid rain and the interaction with state and federal economic regulation, i.e. public utility regulation as carried out by state PUCs and by FERC. While some of those other sections, especially where they interact with Title IV, may affect state and federal regulation in the long run, most of the regulatory action under those sections will be at the EPA level, usually utilizing traditional command and control standards and enforcement mechanisms. A new area of compliance strategies and a system of allowance trading that will interact on a number of important levels with state and federal economic regulation will be produced.
