Mineral leasing on federal lands: a comparison of key leasing elements

Federal lands leasing authority derives primarily from a few major statutes. However, over the years, these have been amended, regulations have been put in place and non-leasing statutes (principally in the environmental area) have affected the leasing program for different minerals. The result is a complex leasing structure for the various energy resources. This paper provides a summary of the key elements of the leasing systems for major energy resources. The resources covered are oil and gas (both onshore and offshore), coal, oil shale and tar sands. Although all of the leasing systems have common elements, they also have unique features. The leasing systems for some of these energy resources were the subject of proposed changes during the last session of Congress and will be considered again in future sessions. Moreover, while a permanent leasing program has been proposed for oil shale, such a program has not been finalized. The summarization in this paper of leasing systems on a common basis provides a convenient means of comparison for those with interests in reviewing leasing policy and proposed changes. 22 references.
