Title: Medical and health issues in coal arbitration

The role of arbitration in settling coal mining health and safety issues is limited in each case to the facts and contractual provisions which apply to a specific grievance. The author reviews various situations under the physical or mental inability to perform the work, personnel or sick leave, allergies, and alcoholism. The weight given to medical opinions needs to be tempered by good faith on the part of management. Personnel have the right to seek opinions from physicians of their choice to supplement the opinions of company medical staff.
