Superfund: a legal update

The 1980 Superfund legislation broadens the response and liability assignment of toxic pollutants, but fails to provide for private recoveries or to cover oil spills. Legislative hopes to replace it with a more comprehensive measure seem dim at present. A review of the Comprehensive Environmental Response Compensation and Liability Act (CERCLA) examines the response authority, controversial liability provisions, the mechanisms for claims against the fund, and other provisions. The prospects for implementation may be limited because of administration policies and budget cuts, making it essential that the Environmental Protection Agency set rational priorities. High priority should go to improving risk assessment and reflect sensitivity to such nonquantitative factors as public skepticism or government intentions. 37 references. (DCK)
