Canadian federalism and the regulation of oil: 1960-1985

During the past decade there has been a tremendous increase in the interaction between Ottawa and the producing provinces in the energy sector and a proliferation of regulations governing the petroleum industry. While there have been numerous studies of federal-provincial struggles over revenue-sharing, questions relating to the regulation of the industry within the context of Canadian federalism have neither been systematically asked nor explored. This dissertation examines the multitude of factors that explain how and why federal and provincial governments altered the scope and nature of their regulation of the oil industry in response to changes in the petroleum sector created by the oil crisis of 1973-1974. Specifically, the author determines how much of the change in regulatory authority can be explained by developments in the federal-provincial arena and how much must be explained by other variables. Three types of regulation are studied: taxation, price controls, and management of production and supply. The development of federal and provincial regulations governing the oil industry in the period 1960 to 1985 is documented. Both regulatory regimes are described and the interaction between Alberta and Ottawa on the one hand, and between industry and the two governments on the other, are analyzed.
