Nuclear waste: Institutional relations under the Nuclear Waste Policy Act of 1982
The Nuclear Waste Policy Act of 1982 requires the Department of Energy to construct the nation's first permanent deep underground nuclear waste repository and stipulates that DOE is to consult and cooperate with states and Indian tribes to promote their confidence in the safety of the disposal program. States and Indian tribes are concerned about the potential environmental and socioeconomic impacts of siting a repository in their region and believe that DOE has not allowed them to participate in the program to the extent intended by the act. These views have led to lawsuits between DOE and the affected states and tribes. GAO believes that DOE can better involve states and tribes and thereby lessen their concerns about their amount of participation.
