Restructuring under PUHCA: Can the '35 Act envelope be stretched
All parts of the electric utility industry agree that the Public Utility Holding Company Act of 1935 ('35 Act) is an obstacle to the development of the independent power industry. They do not agree on whether that is a good thing. The authors take no position on that issue, instead review the '35 Act, describe the obstacles it presents and the strategies used to data to circumvent these obstacles, and then outline a few additional approaches that might be useful in extending the '35 Act envelope. They concentrate on the Public Utility Regulatory Policies Act of 1978 (PURPA), the first major step in development of the independent power industry. PURPA was intended to stimulate alternative energy production, in large part to reduce the use of foreign oil. Small power producers and cogenerators that satisfy detailed criteria of PURPA as qualifying facilities are entitled to significant regulatory advantages.
