Environmental mediation: Can it help resolve coal disputes

There has been a search for an effective alternative for resolving disputes over environmental issues. Properly employed, and in suitable situations, environmental mediation can be such a remedy; it has proved less costly and time consuming than litigation, and has produced agreements honored by the parties to the mediation. Why has it not been employed more extensively. And what is its potential for helping to resolve disputes related to coal mining and other mineral extraction. What are some of the disadvantages, weaknesses, or failures of environmental mediation. There are a number, of course, but the most important probably are those that involve 1) representation - that is to say, who is involved in the mediation process - and 2) the matter of closure and implementation. Let's consider each of these briefly.
