When the court held that an emission offset plan complied with the Clean Air Act, it cleared the way for construction of the second largest oil refinery on the East Coast. The refinery controversy pitted environmentalists and community groups against the Hampton Roads Energy Company and government agencies. A review of the case illustrates the metamorphosis of a law in a given political and economic context. The same economic pressures that caused the Environmental Protection Agency to reassess its initial opposition to new sources in nonattainment areas came to bear on the newly created means of gaining entry to such areas. International events as well as national and local political interests intensified the pressures. Citizens Against the Refinery's Effects (CARE) v. EPA shows the use of the offset policy to obscure allocative goals of the Clean Air Act.
