Title: Audit of the proposed sale of Alaska Power Administration

The Department of Energy (Department) has proposed selling the Alaska Power Administration (APA) to the state of Alaska and local utility purchasers. In early 1992 Congress received the Department's current proposed sale legislation. The objective of this audit was to determine whether the terms of the proposed sale of APA would protect the financial interests of the US taxpayers. The audit showed that issues raised by the General Accounting Office (GAO) as late as 1990 and in prior years remain relevant to the current consideration of the sale of APA. Further, we found that a decision had been made to dispose of APA without following the requirements of the Property Act. We pointed out to the Department in informal conversations that the proposed sale appeared subject to the provisions of the Property Act. Subsequently, the Department modified its draft legislative proposal to include language designed to exclude the sale from the requirements of the Property Act. Due to divergent opinions regarding the proposed sale of APA, we believe the Department should fully inform the Congress, during its deliberative process, as to the issues raised above.
