Mediation provisions and options in Canadian environmental assessment

The Canadian Environmental Assessment Act (CEAA) was passed in June, 1992, and is expected to come into full effect in the near future. Once proclaimed, the Act will give legal force to federal responsibilities and procedures for the conduct of environmental assessment (EA). In the past, these were exercised under the authority of Cabinet directive, most recently in the form of the 1984 Guidelines Order. Several major changes to the existing environmental assessment and review process (EARP) are made in the new legislation. The provision for mediation of EA issues is a particularly important departure from current practice, and the focus of this paper.
