New tax law provides few incentives for solar

The solar and renewable energy aspects of the Economic Recovery Tax Act of 1981 are reviewed. Overall, the new tax law provides few incentives for use of solar energy. No incentives for the use of solar, wind, energy conservation, or other renewable energy systems used in homes, apartments, or for non-business purposes is reported. Depreciation of equipment (including solar) is discussed in terms of the new depreciation schedule (3, 5, 10, and 15 years). Most solar equipment is a structural feature of the building and is depreciated at the 15 year schedule. Lease financing rules in the new tax laws are discussed, particularly as they apply to solar and energy conservation equipment. The new building rehabilitation credits program is discussed. This provides tax benefits for retrofits of buildings 30 years old or older. Tax credits for research and development and at risk investment tax credits are reviewed. A number of benefits in the new tax laws for small businesses (including solar and renewable energy sources) are discussed. (MJJ)
