RCRA: a legal/regulatory perspective

This paper discusses certain major issues under the Resource Conservation and Recovery Act currently being considered. The issue of high volume wastes (created by burning fossil fuels - fly ash, bottom ash, and flue gas emission control waste) is discussed in detail. The 1984 RCRA amendments are discussed. Specific analysis is presented for the following: the land disposal ban, linear requirements, increased corrective action requirements for disposal facilities, restrictions on the burning of hazardous waste as fuel, regulation of used oil, new enforcement provisions, possible changes to subtitle D requirements for non-hazardous waste, and the underground storage tank program.
